AHPA’s 40 Herbs We Love – No. 14: Slippery Elm Bark (with love from Mueggenburg Farms)

AHPA’s 40th anniversary celebrations continue with our showcase of the fourteenth of many beloved herbs at the heart of our robust industry and vibrant community.

No. 14: Slippery Elm Bark (Ulmus rubra)

A staple in the U.S. herbal tradition, slippery elm bark (Ulmus rubra) is one of the main driving forces in the wild harvesting market in Appalachia.

Slippery elm is harvested in a narrow window in the early summer months, just as the sap is coming out of the trees. The bark is then stripped vertically and the bark "slips" right off, upon which the bark is dried and prepared for cutting or powdering. Its unique mucilage properties make the inner-bark of slippery elm an invaluable herb in many throat-soothing teas and dietary supplements.

As tricky as the cutting and processing of the bark may be, its health benefits and positive economic impact in the rural areas of Appalachia make it one of the many reasons slippery elm bark is an herb we love!

No. 13: Magic Mushrooms (Psilocybe cubensis)

AHPA opposes MPL provisions in FDASLA Act

June 17, 2022

On Tuesday, June 14, the Senate HELP Committee advanced S. 4348, the Food and Drug Administration Safety and Landmark Advancements (FDASLA) Act, a “must-pass” bill that reauthorizes drug and medical device user fee programs.

The legislation, which passed out of Committee by a vote of 14 to 9, contained language establishing mandatory product listing (MPL) requirements for dietary supplements. The measure also grants FDA with a new authority to enforce against products “marketed as” dietary supplements that do not meet the law’s definition of “dietary supplement.”

AHPA opposes S. 4348 as passed out of the Senate HELP Committee. AHPA views the MPL provisions contained within S. 4348 as creating unnecessary, significant, and redundant burdens on industry. Moreover, to date, neither the U.S. Food and Drug Administration (FDA) nor other advocates for MPL have clearly articulated the need for this premarket product listing requirement.

An amendment offered by Sen. Mitt Romney (R-UT) during the HELP Committee markup of S. 4348 would have required FDA to provide a written justification in making a request of a manufacturer to provide the quantities of dietary ingredients in a product’s proprietary blend (rather than requiring inclusion of this information in each product listing) and dietary ingredient supplier information (rather than permitting FDA requests for this information without justification). The Romney amendment was rejected on a 11-to-11, party-line vote.

The MPL language contained in the Committee passed version of S. 4348 is similar, but not identical to, the provisions in Sens. Durbin and Braun’s S. 4090, the Dietary Supplement Listing Act of 2022, which was introduced on April 22. On April 27, AHPA issued a statement in opposition to S. 4090. The House of Representatives passed its FDA user fee reauthorization measure, H.R. 7667, the Food and Drug Amendments of 2022, on June 6. H.R. 7667 contained neither MPL language nor any other dietary supplement related provision.

In the coming weeks, AHPA will advocate before the U.S. Congress that MPL language be removed from the final version of the user fee reauthorization measure. As a Congressional hearing has yet to be held on MPL issues, AHPA will urge Senators and House Members to take a step back and thoroughly examine MPL and other important dietary supplement issues through the normal Congressional review process—and not hurriedly shoehorn MPL language into legislation designed to reauthorize FDA’s unrelated user fee programs.

AHPA drives revisions to California weight loss product bill

June 15, 2022

A California bill which threatened consumer access to many safe dietary supplements has been amended to resolve concerns by the affected industry. Assembly Bill 1341, sponsored by Assemblymember Cristina Garcia, had originally applied extensive physical access and age restrictions to a broadly defined class of dietary supplement and OTC products “sold for or used with the intent to achieve weight loss."

With the help and input of members of the American Herbal Products Association (AHPA) Sports Nutrition Committee and a coalition of other trade associations, AHPA staff developed alternative language for the bill and presented it to Assemblymember Garcia. Following several rounds of discussions, much of this language has now been incorporated into the bill by amendment in the California Senate.

As amended, the bill has no physical access restrictions and greatly narrows and clarifies the covered product definition. The remaining restriction bars individuals under 18 from purchasing dietary supplements that are both a) “labeled, marketed, or otherwise represented for the purpose of achieving weight loss”, and b) found by the California Department of Public Health, as part of a stakeholder consultation, to both meet the above definition and contribute to specific health conditions. Dietary fiber products are also excluded from the bill’s scope, and individuals under 18 can access covered products with a prescription.

Following the incorporation of these amendments, AHPA has withdrawn its opposition to AB 1341. AHPA continues to monitor similar restrictive legislation in several other states.

FDA launches dietary supplement education initiative

The U.S. Food & Drug Administration (FDA) has launched a new education project that claims to broaden public understanding of dietary supplements. The campaign, titled “Supplement Your Knowledge,” includes infographics, fact sheets, and videos targeted at consumers, educators, and healthcare professionals.

While the American Herbal Products Association (AHPA) continues to closely review these materials, several place a heavy emphasis on the potential “health risks” of dietary supplements use and question their benefits. For example, included among high school curricular material about dietary supplements is a video from Consumer Reports on “snake oil” and other patent medicines marketed before the 1906 passage of the Pure Food and Drug Act.

“This emphasis on risk sounds more like the FDA of the 70s and 80s than today’s ODSP staff,” said AHPA President Michael McGuffin. “It’s also disingenuous to link safe dietary supplements with snake oil from more than a century ago.”

AHPA’s 40 Herbs We Love – No. 11: Hawthorn (with love from Herbalist & Alchemist)

AHPA’s 40th anniversary celebrations continue with our showcase of the eleventh of many beloved herbs at the heart of our robust industry and vibrant community.

No. 11: Hawthorn (Crataegus monogyna, C. laevigata)

Hawthorns (Crataegus spp.) are small shrubby trees that produce procyanidin-rich berries, flowers, and leaves. Research shows regular consumption of these phenolic compounds may have a positive effect on a wide range of cardiovascular conditions, likely due to their significant antioxidant activity and ability to support the body’s natural inflammatory response.

First used in France as a syrup to strengthen and nourish the heart in the 1600’s, their use spread throughout Europe and to the US, where Eclectic physicians used Hawthorn to support cardiovascular health.

Hawthorn can be taken as a tincture, tea, capsules, or one of our favorite forms, a solid extract. No. 10: Senna (C. Senna)

Senna is an unforgettable herb with an irreplicable power. This small but mighty shrub is a trusted ally when you’re in a jam.

Senna has a long-standing history of use for overnight relief of occasional constipation. Rich in compounds known as sennosides, it stimulates muscular contractions in the intestines while helping to draw in moisture. This results in a laxative effect 6-12 hours after consumption.

Much of Traditional Medicinals’ organic senna is grown in India, in the Thar Desert in Rajasthan. In 2009, we launched the Revive Project, now led by our partner WomenServe, in efforts to lessen the equity gaps—like access to water and education—in these rural farming communities.
