The Modernization of Cosmetics Regulation Act of 2022 (MoCRA) is the most significant expansion of FDA’s authority to regulate cosmetics since the Food, Drug and Cosmetic Act of 1938. MoCRA provides new authorities to FDA including records access and mandatory recall authority. The legislation also establishes new requirements for industry including adverse event reporting, facility registration, product listing, and safety substantiation. The FDA recently released a draft guidance describing its plans for the registration of cosmetic products facilities and listing of cosmetic products, two new regulatory requirements with an initial compliance date of December 29, 2023.
