A New York law applying age restrictions and onerous delivery requirements on weight loss and muscle building supplements went into effect this April, and the vague scope of the law means that a wide variety of other products may also be affected. With one law on the books, the likelihood is now high that similar laws will pass elsewhere, amplifying the fundamental long-term hazard that state dietary supplement restriction laws present for the entire dietary supplement industry: the emergence of an inconsistent, 50-state patchwork of restrictions that cover different products and impose different burdens. In this opening session, our panel of expert speakers will emphasize the need for the dietary supplement industry to coalesce around a consistent strategy that can head off the precedent of a chaotic multistate restriction scheme.

The botanical supply chain is facing an unprecedented array of challenges that impact the availability and cost of ingredients. Climate change, drought and severe weather events are impacting crop yields and the transportation of goods. Industry supply chains face risks from political instability and economic volatility. In addition, increased tariffs on Chinese imports have been in place since 2019, increasing the cost of herbal product ingredients. This session will take a closer look at some of the current botanical supply chain challenges and the need to build awareness of these issues for all parts of the natural product industry.

In April 2024, Amazon announced updates to its dietary supplement policy, requiring that sexual enhancement, weight management and sports nutrition/bodybuilding supplements submit third-party verification to meet safety standards on their e-commerce retail platform. The testing must be performed or verified by one of three Testing, Inspection and Certification (TIC) organizations. In this session, an Amazon representative will speak to the new standards and what lies ahead. Representatives from each of the TICs (Eurofins, UL Solutions, and NSF International) will share updates on their implementation of the updated policy.
